Please read the WattGrinder Engineering, Inc. Web Site Agreement in its entirety before accessing or using this Site. By accessing or using this Site, you understand and agree to the terms and conditions set forth in this agreement. Terms and conditions, as set forth in this agreement, may be changed at any time without notification and are effective immediately upon posting.   It is your responsibility to review this agreement periodically to be aware of any changes.  If you do not agree to the terms and conditions as set forth in this agreement and you do not agree to review the agreement periodically for changes you may not use or access www.wattgrinder.com.  “This Site” refers to all directories and pages contained in www.wattgrinder.com.

This Site is to be used only by persons age 18 or older.  Children under the age of 18 may use this site only with the supervision and consent of a parent or guardian.

All content is protected by all copyright and trademark laws. Except as where may be otherwise expressly provided for in this Site,  it is strictly prohibited to republish, copy, modify, upload, post, transmit, reproduce in any manner any content including graphics, text and software. Product and company names alluded to on this Site may be trademarks of their respective owners.

Any reference to products, recordings, events, processes, publications, services or offerings by a third party does not imply an endorsement or recommendation of WattGrinder Engineering, Inc.  Views of third parties are strictly the views of those third parties and therefore WattGrinder Engineering, Inc. bears no responsibility for the accuracy of said views.

Using this Site, you understand that the nature of the internet contains unedited materials and these materials may be sexually explicit or offensive to you.  Your access to these materials is at your own risk.  This Site has no control over and accepts no responsibility whatsoever for such materials.

User Conduct

It is strictly prohibited to post or send any material on the WattGrinder Engineering website that is pornographic, obscene or indecent, distasteful, inflammatory, hateful, blasphemous, abusive, harmful, threatening, defamatory, or libelous.  You may not post misleading or dishonest statements anywhere. You may not use expressions of bigotry, racism, hatred, or profanity. You may not impersonate any other person or submit false or inaccurate information about yourself.  You may not use this Site to conduct any activity that is illegal, or violates the rights of others and you may not provide instruction or information about illegal activities or promote physical harm or injury against any group or individual. You may not post serial numbers, advertising, surveys or promotional materials, contests, or any other form of solicitation. 

You may not upload, transmit, or distribute any software viruses, or any other code, files or programs designed to interrupt, destroy, modify, or limit the functionality of another computer, software or this Site. You may not use any web robot, spider, scraper or other automated means to access this Site for any purposes.  

You are permitted to view this Site only in its full presentation form.  You are prohibited from framing this Site.

You understand and agree that WattGrinder Engineering, Inc., in its sole discretion, will terminate your access to this Site without liability to you or any third party if you violate the Terms of Use Agreement or interfere with other’s access or use of this site.

Indemnification

Using this site you agree to indemnify, defend and hold harmless any and all officers, employees, agents, licensors, suppliers and third party information providers to this Site from and against all losses, expenses, damages and costs, including reasonable attorney’s fees, resulting from any violation of this Agreement (including negligent or wrongful conduct) by you or any other person accessing this Site. 

Disclaimer of Warranties and Limitation of Liability

This Site is provided “as is” without warranty of any kind, either express or implied, and  WattGrinder Engineering, Inc. in no event shall assume any liability for information errors contained on this Site.  WattGrinder Engineering, Inc. shall not be liable for any damages or losses to you as a result of using information or material on this site. At no time and in no event will this Site be liable for any incidental, consequential, or indirect damages arising out of the use of or inability to use this Site. This Site shall not be responsible for any cost or damage arising either directly or indirectly from any transactions.   It is solely your responsibility to evaluate the accuracy of any transaction. Because some states do not allow the exclusion or limitation of liability for consequential or incidental damages, the above limitation may not apply to you.

Laws of California and the United States

The laws of California and the United States shall govern use of this Site.  Users agree that any action, lawsuit, or proceedings arising from or related to the use of this Site shall be brought exclusively in the federal or state courts of the State of California without regard to choice of law or conflicts of law provisions.  Failure of WattGrinder Engineering, Inc. to insist upon or enforce any right or provision of these terms and conditions shall not constitute a waiver of such right or any provision of these terms and conditions.
